2. Definitions
In these Terms & Conditions:
- "We", "us", "our" refers to Fivty9 Performance
- "You", "your" refers to the customer or visitor to our website
- "Products" refers to the automotive parts, accessories, and any other goods listed on our website
- "Website" refers to fifty9performance.co.uk
3. Eligibility
By placing an order on our website, you confirm that you are at least 18 years of age or have the consent of a parent or guardian, and that you are legally capable of entering into a binding contract.
4. Orders & Contract Formation
All orders placed through our website are subject to acceptance and availability. The process works as follows:
- When you place an order, you are making an offer to purchase the products in your basket
- You will receive an order confirmation email acknowledging your order — this is not acceptance of your offer
- A legally binding contract between you and Fivty9 Performance is formed only when we dispatch your goods and send a dispatch confirmation email
We reserve the right to refuse or cancel any order at our discretion, for example if a product is out of stock, there is a pricing error, or we suspect fraudulent activity. If we cancel an order, you will be refunded in full.
5. Pricing & Payment
All prices displayed on our website are in British Pounds (GBP) and include VAT where applicable. We make every effort to ensure pricing is accurate, but errors may occasionally occur. If we discover an error in the price of a product you have ordered, we will contact you before dispatching and give you the option to proceed at the correct price or cancel your order for a full refund.
We accept payment via Shopify Payments (Visa, Mastercard, American Express, Apple Pay, Google Pay), Klarna, and Clearpay. Full payment is required before goods are dispatched, unless using an approved buy-now-pay-later service. For more details, please see our Secure Payment page.
6. Product Descriptions & Accuracy
We take care to ensure that product descriptions, images, and specifications are as accurate as possible. However, product images are for illustration purposes and the actual product may differ slightly in appearance. We do not warrant that product descriptions or other content on our website are entirely error-free.
Vehicle compatibility: It is the customer's responsibility to ensure that any parts or accessories ordered are compatible with their vehicle. If you are unsure about fitment, please contact us before purchasing. We cannot accept returns for parts ordered in error that are not compatible with your vehicle, unless the product is unused and in its original condition (subject to our Returns & Refunds policy).
7. Delivery
We aim to dispatch all orders within 1–2 working days. Delivery times depend on the shipping method selected at checkout and are estimates only. For full details on delivery options, timeframes, and charges, please refer to our Shipping Policy.
Risk in the products passes to you upon delivery. Ownership of the products passes to you once we have received payment in full.
8. Cancellations, Returns & Refunds
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods. 9. Warranty & Faulty Goods
All products sold by Fivty9 Performance are covered by your statutory rights under the Consumer Rights Act 2015. In addition, many products carry a manufacturer's warranty. For full details, please refer to our Warranty Policy page.
10. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
Subject to the above, Fivty9 Performance shall not be liable for:
- Any indirect, incidental, or consequential loss or damage
- Loss of profit, business, revenue, goodwill, or anticipated savings
- Any loss arising from the incorrect installation or use of products purchased from us
- Any damage to your vehicle or property caused by the fitment or use of products, unless the product was faulty at the time of delivery
Our total liability to you for any claim arising from or in connection with a purchase shall not exceed the price paid for the product in question.
11. Intellectual Property
All content on our website — including text, images, logos, graphics, and software — is the property of Fivty9 Performance or our licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content from our website for commercial purposes without our prior written consent.

You agree to use our website only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the website. Prohibited behaviour includes but is not limited to:

Fivty9 Performance shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, government actions, war, terrorism, pandemics, supplier failures, or disruption to transportation networks.

We reserve the right to update or amend these Terms & Conditions at any time. Any changes will be posted on this page with the updated "Last Updated" date. Continued use of our website after changes are posted constitutes acceptance of the revised terms.
17. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms affects your rights as a consumer to rely on such mandatory provisions of local law.
18. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these terms and shall not affect the validity and enforceability of the remaining provisions.

Shipping Policy

1. Processing Times
Orders are processed Monday to Friday, 9:00 AM – 5:00 PM. We are closed on weekends and UK bank holidays. Orders placed after 5:00 PM or on weekends will be processed on the next working day.
Most orders are dispatched within 1–2 working days. During busy periods (sales, promotions, bank holidays), processing may take up to 3 working days. If there is a delay with your order, we will contact you by email.

Delivery estimates begin from the date of dispatch, not the date of order. Delivery times are estimates and not guaranteed, though we do our best to meet them.
3. International Delivery
We may offer international shipping on selected products. International delivery times and costs vary by destination and will be calculated at checkout. Please note:
- International orders may be subject to customs duties, import taxes, or fees imposed by the destination country — these are the responsibility of the buyer.
- Delivery times for international shipments are estimates and may be affected by customs clearance processes.
4. Shipping Carriers
We use a range of trusted carriers depending on the size, weight, and destination of your order. These may include Royal Mail, DPD, DHL, Evri (Hermes), and other specialist couriers for oversized or heavy items.
5. Order Tracking
Once your order has been dispatched, you will receive an email with a tracking number and a link to track your delivery. If you have not received a tracking email within 3 working days of placing your order, please contact us.
6. Failed or Missed Deliveries
If a delivery attempt fails, the courier will usually leave a card with instructions to rearrange or collect your parcel. If a parcel is returned to us due to a failed delivery, we will contact you to arrange re-dispatch. Additional shipping charges may apply for re-delivery.
7. Incorrect Address
Please ensure your delivery address is correct at the time of checkout. Fivty9 Performance is not responsible for orders delivered to an incorrect address provided by the customer. If you notice an error, contact us as soon as possible — we will do our best to update the address before dispatch.
8. Damaged or Lost Items
If your order arrives damaged or does not arrive at all, please contact us within 48 hours of the expected delivery date. We will work with the courier to resolve the issue and arrange a replacement or refund where applicable. We may ask for photographic evidence of any damage.

Returns & Refunds

1. Your Right to Cancel (Consumer Contracts Regulations 2013)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. To exercise your right to cancel, you must inform us by a clear statement (e.g. email or phone call) before the cancellation period expires.
Cancellation period: 14 days from the day you (or someone you nominate) receive the goods.
2. Return Conditions
To be eligible for a return, items must be:
- Unused, uninstalled, and in the original condition you received them
- In the original packaging with all labels, tags, and accessories intact
- Returned within 14 days of notifying us of your cancellation
We reserve the right to reduce your refund to reflect any loss in value if the goods have been handled beyond what is necessary to establish their nature, characteristics, or functioning.
3. Non-Returnable Items
The following items cannot be returned unless they are faulty or not as described:
- Parts that have been fitted, installed, or modified in any way
- Electrical items that have been connected or used
- Custom or made-to-order products
- Items marked as non-returnable at the point of sale
- Goods that have been mixed inseparably with other items after delivery
4. How to Start a Return
To initiate a return, please contact us first:
Please include your order number, the item(s) you wish to return, and the reason. We will then provide you with return instructions and a return address. Do not send items back without contacting us first.
5. Return Shipping Costs
Unless the item is faulty, not as described, or incorrect, return shipping costs are the responsibility of the customer. We recommend using a tracked delivery service, as we cannot accept responsibility for items lost in transit back to us.
If the item is faulty or we made an error, we will cover the return shipping cost or arrange collection.
6. Refunds
Once we receive and inspect your returned item, we will notify you of the outcome by email. If approved, your refund will be processed within 14 days of receiving the returned goods. Refunds are issued to the original payment method:
- Shopify Payments / card — refunded to your card (allow 5–10 working days for your bank to process)
- Klarna — your Klarna balance will be adjusted and any pending payments cancelled or refunded
- Clearpay — your Clearpay instalments will be adjusted accordingly
Original delivery charges are refunded only if the return is due to our error or a faulty product. If you received free shipping, no delivery refund applies.
7. Faulty or Incorrect Items
If you receive a faulty, damaged, or incorrect item, please contact us within 48 hours of delivery with your order number, a description of the issue, and photographs where possible. Under the Consumer Rights Act 2015, you are entitled to:
- A full refund if reported within 30 days of receipt
- A repair or replacement if reported after 30 days but within 6 months
- A partial refund may apply for faults found after 6 months if the fault is proven to be inherent
8. Exchanges
We do not offer direct exchanges at this time. If you need a different product, please return the original item for a refund and place a new order.
9. Late or Missing Refunds
If you haven't received your refund within the expected timeframe, please first check with your bank or card provider as processing times vary. If you've done this and still have not received your refund, contact us at Info@fifty9performance.co.uk and we will investigate.

We accept the following payment methods at checkout:

✓ Klarna
Pay in 3 interest-free instalments, or pay later in 30 days. Subject to Klarna's own eligibility and terms.
✓ Clearpay
Split your purchase into 4 interest-free payments, made every 2 weeks. Subject to Clearpay's terms.
✓ Apple Pay & Google Pay
Fast, contactless checkout using your device wallet via Shopify Payments.
2. Payment Security
All payments on our website are processed through Shopify Payments, which is built on Stripe's infrastructure. This means:

- 🔒 256-bit SSL encryption — your data is encrypted during every transaction
- 🔒 3D Secure authentication — additional verification for card payments where required by your bank

We do not store, access, or have visibility of your full card number, CVV, or banking credentials at any point. All sensitive payment data is handled entirely by our payment processors.
3. Buy Now, Pay Later
Klarna and Clearpay are third-party buy-now-pay-later services. When you choose one of these options at checkout:
- Your eligibility is assessed by Klarna or Clearpay directly — we have no involvement in credit decisions
- Your payment relationship is between you and the provider, governed by their terms and conditions
- Late or missed payments may incur fees as set out in the provider's terms
- Refunds for Klarna/Clearpay orders are processed through the respective provider (see our Returns & Refunds policy)

4. Currency & Pricing
All prices displayed on our website are in British Pounds (GBP) and include VAT where applicable. The total you see at checkout is the final amount charged — there are no hidden fees from us.
For international orders, your bank or card provider may apply a currency conversion fee — this is outside of our control.
5. Payment Issues
If your payment is declined or you experience issues at checkout, please try the following:
- Check that your card details are entered correctly
- Ensure your card has not expired and has sufficient funds
- Contact your bank — they may be blocking the transaction for security reasons

6. Authorisation & Charges
When you place an order, a payment authorisation is created. Your card is charged only when the order is confirmed and being processed. In rare cases, you may see a pending charge on your statement that will either be captured or automatically released within a few business days.
Warranty Policy

1. Your Statutory Rights
Under the Consumer Rights Act 2015, all products sold to consumers in the UK must be of satisfactory quality, fit for purpose, and as described. These rights apply regardless of any manufacturer warranty and cannot be excluded or limited.
Within 30 days: Full refund for faulty goods.
Within 6 months: Repair or replacement (refund if repair/replacement fails).
Up to 6 years: You may still have a claim if you can prove the fault was present at delivery.
2. Manufacturer Warranties
Many of the automotive parts and accessories we sell come with a manufacturer's warranty provided directly by the brand or supplier. Warranty periods and terms vary by product and manufacturer.
Where a manufacturer warranty applies, details are typically included with the product packaging or documentation. Manufacturer warranties are offered in addition to your statutory rights — they do not replace or limit them.
If a product carries a specific manufacturer warranty, this will be noted on the product page where possible.
3. What Is Covered
Warranty coverage (whether statutory or manufacturer) generally applies to:
- Manufacturing defects and faults present at the time of delivery
- Premature failure under normal use as intended by the manufacturer
- Products that are not as described on our website at the time of purchase
4. What Is Not Covered
Warranty does not cover issues arising from:
- Normal wear and tear
- Incorrect installation or fitment (including professional installation errors)
- Misuse, abuse, neglect, or accidental damage
- Modifications, tuning, or alterations to the product
- Use in motorsport, track days, or competitive events (unless the product is explicitly designed and sold for such use)
- Cosmetic damage that does not affect the function of the product
- Failure caused by use with incompatible vehicles or components
5. How to Make a Warranty Claim
If you believe a product is faulty or covered under warranty, please contact us with the following information:
- Your order number and date of purchase
- The product name and a description of the fault
- Photographs or video showing the issue (where applicable)
- Details of the vehicle and how the product was installed (if relevant)
We will assess your claim and respond within 5 working days. Depending on the product and nature of the fault, we may request the item be returned to us for inspection. We will cover return shipping costs for valid warranty claims.
6. Resolution
If a warranty claim is approved, we will offer one of the following at our discretion (and in line with your statutory rights):
- Replacement — a like-for-like replacement of the faulty product
- Repair — arrangement for the product to be repaired
- Refund — a full or partial refund depending on the circumstances and timeframe
Where a manufacturer handles the warranty claim directly, we will assist in liaising between you and the manufacturer.
7. Proof of Purchase
All warranty claims require valid proof of purchase from Fivty9 Performance. This can be your order confirmation email, Shopify order number, or any receipt issued at the time of purchase.

Once your order has been dispatched, you'll receive a shipping confirmation email containing your tracking number and a direct link to track your parcel. Here's what to do:
Check Your Email
Look for the shipping confirmation email from Fivty9 Performance. Check your spam/junk folder if you can't find it.
Click the Tracking Link
The email contains a tracking number and a link to the courier's tracking page. Click it to see real-time updates.
Check Your Shopify Account
If you created an account at checkout, you can log in and view your order status and tracking details directly on our website.
2. Order Statuses Explained
- Order Confirmed — we've received your order and payment has been authorised
- Processing — your order is being prepared for dispatch
- Dispatched / Shipped — your order has left our facility and is with the courier
- Out for Delivery — the courier is delivering your parcel today
- Delivered — your parcel has been delivered to the address provided
3. Estimated Delivery Times
After dispatch, estimated delivery times depend on the shipping method selected at checkout:
- Standard Delivery: 2–5 working days
- Express / Next Day: 1–2 working days
- International: Varies by destination
Please note that delivery times are estimates and may be affected by courier volumes, weather, or other circumstances outside our control.
4. Haven't Received a Tracking Email?
If you haven't received a tracking email within 3 working days of placing your order, here's what to check:
- Check your spam/junk email folder
- Make sure the email address on your order is correct
- Some items may ship directly from our suppliers and tracking may arrive separately

5. My Tracking Says Delivered but I Haven't Received It
If the courier's tracking shows your parcel as delivered but you haven't received it, please:
- Check with household members or neighbours who may have accepted the delivery
- Look for a "safe place" delivery — the courier may have left it in a porch, garage, or other location
- Check for a card or notification from the courier
If you still can't locate your parcel, contact us within 48 hours and we will open an investigation with the courier.
